LongLine
No you are still required to have a license for each person and you are paying for the opportunity to catch fish not the actual fish. The charters don't charge buy the pound for fish caught just a flat fee for a fishing experience. What about those that guarantee a fish or you don't have to pay? I'm sure those selling laws were aimed at guys selling to stores or trying to make some cash and not paying taxes. Also, who knows what health laws/guidelines get ignored?

Like fishy1 said, you're paying for the opportunity to catch fish. In your example, the charter didn't succeed in presenting that opportunity so they don't charge for the "boat ride". Not that it matters. BTW, from what I know, they usually don't guarantee fish, they guarantee fish on.
